SUBJECT: STATUS OF ACADEMIC STAFF
 
POLICY: MSUE provost-appointed academic staff are salaried-employees and, therefore, exempt from the provisions of the Fair Labor Standards Act (FLSA) which provides for overtime pay and/or compensatory time for work beyond a normal 40 hour work week.

PROVISIONS/RESTRICTIONS:
 

The forty-hour work week applies to certain non-academic staff (secretaries, program assistants or associates, etc.) who are considered non-exempt. 

 MSUE provost-appointed academic staff are considered salaried employees and are exempt from the requirements of a forty-hour week.  Provost-appointed staff are hired to fulfill the responsibilities of the position.  The commitment of time in this role can sometimes be more than forty hours.  Staff in an exempt status do not receive overtime or compensatory time when their work requires them to go beyond what is considered a normal work week.  The role of Extension Educator requires that they set their individual schedule, determine their annual objectives, and work in an independent manner.  Educators are personally accountable for time management and meeting performance objectives.


Employees should discuss issues of scheduling, office coverage, and staff supervision (if applicable) with the County Extension Director.  Flexible scheduling should be managed in such a manner as to minimize impact on clientele and office operations.
