| SUBJECT: | MSU LIABILITY COVERAGE |
| POLICY: | Michigan State University provides legal protection that covers employees and volunteers with respect to liability claims arising from alleged negligence and other accidental occurrences that cause personal injury and/or property damage. |
| APPLIES TO: | MSUE employees, volunteers while providing services on behalf of MSU or under the direction of an MSU representative, all while performing within the scope of their assigned duties. Also, unincorporated clubs, associations, advisory boards and the like under the control of or using the name of MSU or MSUE. |

PROVISIONS/ |
The University's policy governing its provision of legal
support, that is, indemnification, is stated in the Faculty Handbook,
as follows:
Michigan State University will support its trustees, officers, faculty, and staff when acting in the performance of assigned duties on behalf of the University. This policy also applies to students while engaged in approved academic programs and volunteers who are performing services for the University with prior written approval of the appropriate University official. The University will defend, save harmless, and indemnify such persons against any suit or proceeding, wherever brought, premised upon the fact that he or she is or was a member of the Board or an officer, employee, student, or volunteer of the University. The indemnity extends to expenses including attorney fees, judgments, fines, and amounts paid in settlement, actually and reasonably incurred, and with respect to any criminal action or proceeding where such person had no reasonable cause to believe that his or her conduct was unlawful. As a condition of indemnification, the trustee, official, employee, student, or volunteer is required to cooperate fully on a continuous basis with the University Attorney and the Office of Insurance and Risk Management. |
| PROCEDURE: |
1. Incidents involving personal bodily injury or property damage which may give rise to a claim should be reported immediately. 2. An incident report form is sent to the Office of Risk Management and Insurance with a copy to the ANR Human Resources office. 3. Incident Report forms are available from the Office of Risk Management, the ANR Human Resources office and the Regional Director’s Office. |
